Missouri's prompt pay law, RSMo § 376.383, gives health carriers 45 processing days to pay a claim. When a carrier misses that deadline, it owes 1% interest per month plus a penalty of 1% of the claim per day. For unpaid balances over $35,000, the daily penalty is capped at 100 days, and interest then rises to 2% per month.
The companion statute, § 376.384, requires claims to be submitted electronically in HIPAA standard format and bars carriers from seeking refunds more than 12 months after paying a claim, except for fraud or misrepresentation. On the Medicaid side, MO HealthNet claims must be received within 12 months of the date of service under 13 CSR 70-3.100. Timely claims that are denied can be resubmitted within 24 months.
